{"id":205,"date":"2026-04-12T15:23:38","date_gmt":"2026-04-12T15:23:38","guid":{"rendered":"https:\/\/eatper.com\/?page_id=205"},"modified":"2026-08-12T08:05:41","modified_gmt":"2026-08-12T08:05:41","slug":"terms-of-use","status":"publish","type":"page","link":"https:\/\/eatper.com\/fi\/terms-of-use\/","title":{"rendered":"Terms of Use"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><strong>Eatper Terms of Use<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Version:<\/strong> 1.0.0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Effective date:<\/strong> 12 August 2026<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Last updated:<\/strong> 12 August 2026<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms of Use (the <strong>Terms<\/strong>) govern your use of the Eatper mobile application, your Eatper account, and the related websites, cloud services, reports, exports, support, and other features that link to these Terms (together, the <strong>Service<\/strong>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is provided by:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Perplatform Oy<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Business ID: 3568783-4<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vilkastuksenkatu 7<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">20320 Turku<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finland<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Email: support@eatper.com<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In these Terms, <strong>Eatper<\/strong>, <strong>we<\/strong>, <strong>us<\/strong>, and <strong>our<\/strong> mean Perplatform Oy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. Agreeing to these Terms<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You agree to these Terms when, after being shown a link to them, you select <strong>Create account<\/strong>, <strong>Agree and continue<\/strong>, or another button that clearly states that selecting it means agreement. If you do not agree, do not create or use an Eatper account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your privacy choices are separate from your agreement to these Terms. The Eatper Privacy Policy explains how we process personal data. Where Eatper asks for consent to process health-related data, personalized reports, analytics, notifications, or another optional purpose, that consent is requested separately and may be withdrawn as described in the Privacy Policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We record the Terms version and the time of your agreement so that we can administer the contract and demonstrate which version applied. Ordinary sign-in or continued use does not by itself create a new acceptance record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. Who may use Eatper<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must be at least 18 years old and legally able to enter into these Terms. Eatper asks for your date of birth as a self-declared age check; it does not perform identity or documentary age verification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is not directed to children or anyone under 18. If you are under 18, do not create an account or use the Service. If we reasonably believe an account belongs to someone under 18, we may restrict it and request information needed to resolve the issue or delete it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may use the Service only where doing so is lawful. Some features, catalogue content, subscriptions, or third-party services may not be available in every country, language, device, or app-store region.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. Eatper is a general wellness tool, not medical care<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Eatper helps adults record food, weight, goals, and related information; estimate nutrition targets; and view general wellness reports and insights. Eatper is not a medical device, healthcare provider, diagnostic service, or substitute for a physician, registered dietitian, or other qualified professional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Service does not diagnose, treat, cure, monitor, or prevent any disease or medical condition. Calculations, targets, nutrient values, trends, and reports are estimates and may be incomplete, outdated, or wrong. Individual needs vary, and the Service cannot account for every medical condition, medication, pregnancy, allergy, intolerance, eating disorder, or other circumstance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not use Eatper:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>as the sole basis for a medical, treatment, medication, or emergency decision;<\/li>\n\n\n\n<li>as the sole source of allergen, ingredient, or dietary-suitability information;<\/li>\n\n\n\n<li>to replace product labels, professional advice, or instructions supplied by a healthcare provider; or<\/li>\n\n\n\n<li>if a clinician has advised you not to track weight, calories, or similar information.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Always check the current product package and label before consuming a food, especially if allergies, intolerances, religious requirements, or medically prescribed diets are relevant. Consult a qualified professional before making a material change to diet, weight, or activity. In an emergency, contact your local emergency service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4. Your account<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may register with email and password or an available third-party sign-in method, currently Google or Apple on supported devices. You must provide accurate information, keep account credentials secure, and promptly tell us at support@eatper.com if you suspect unauthorized access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your account is personal to you. You may not sell, rent, transfer, or share it, except that app-store family or volume-purchase rights may apply to the application licence where the relevant store rules say so. You are responsible for activity under your account to the extent permitted by law, unless it resulted from a security failure for which we are responsible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may connect more than one supported sign-in method to the same account. Removing a sign-in method does not necessarily delete the account or its data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5. Privacy choices and cloud features<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Eatper is designed to store some information locally on your device and, where enabled, synchronize information with Eatper&#8217;s cloud service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because diary entries, weight, body details, goals, and nutrition information may reveal health information, Eatper asks for explicit consent before processing this information in the cloud. If you decline or later withdraw that consent, cloud synchronization and features that require the affected data may be unavailable, and Eatper will queue the affected cloud data for erasure as described in the Privacy Policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Eatper separately asks whether it may use your information to create personalized weekly and monthly reports or insights. You can use the core Service without agreeing to this separate purpose, although personalized reports and related archive features will not be available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Withdrawing consent does not cancel an app-store subscription, and deleting the application from a device does not delete the cloud account. See Sections 7 and 15.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6. Food information and reports<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.1 Food catalogue<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Food information may come from Eatper, users, public datasets, or third-party sources, including Open Food Facts. It may contain errors or be incomplete. Product recipes, serving sizes, labels, and nutrition values also change over time. Eatper does not warrant that any catalogue item matches the food in your possession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Barcode scanning is a convenience feature, not proof that a returned product is the one you scanned. Compare the result with the package before logging or consuming the product.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2 Your custom foods are shared catalogue contributions<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When you create a custom food, its product name, brand, barcode, country, nutrient values, serving information, and other product facts are submitted as a <strong>public contribution to Eatper&#8217;s shared food catalogue<\/strong>. Other authenticated Eatper users may find and use that food. They are not shown your Eatper identity merely because you created the item, but Eatper keeps an internal account link while the contribution remains user-owned so that you can manage it and we can protect catalogue integrity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not put your name, contact details, health information, diary notes, or other personal or confidential information in a custom-food field. Custom foods are removed when the owner&#8217;s account is deleted under Eatper&#8217;s deletion process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.3 Food-data reports and evidence<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may report missing, incorrect, duplicate, or discontinued food information. A report may include structured corrections, notes, and an optional photograph of product packaging or its label. Evidence photographs are private to you and authorized Eatper personnel and are not added to the public catalogue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Only submit accurate information and packaging photographs that you are entitled to provide. Do not submit photographs of people, documents, private spaces, unrelated material, or content that infringes another person&#8217;s rights. We may reject, edit, combine, de-identify, or remove reports and corrections. Factual corrections may remain in the catalogue without an account link after your account is deleted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.4 Reports and insights<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Weekly and monthly reports, trends, adherence measures, comparisons, and insights are generated from your recorded data. They are general wellness information, not professional advice or a guarantee of outcomes. A free plan may include access to the latest reports, while paid features may include archives, longer-term views, or PDF and CSV exports. The current paywall and store listing state the features included in each plan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7. Subscriptions, renewal, cancellation, and refunds<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Eatper may offer free and paid features. As of the effective date, Eatper offers a monthly subscription at <strong>\u20ac7.99 per month<\/strong> and an annual subscription at <strong>\u20ac39.99 per year<\/strong> in the Finnish storefront, with no free trial. Prices, currency, tax treatment, and availability may vary by country and storefront. The price and billing period displayed by Apple App Store or Google Play immediately before purchase are the controlling purchase terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Paid subscriptions are sold and billed by the app store connected to your device. They automatically renew for the same billing period unless you cancel through that store before renewal within the time required by the store. Your store account will be charged according to the confirmation shown at purchase.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can manage or cancel through your Apple App Store or Google Play subscription settings. Cancellation normally stops future renewal and lets you retain paid access until the end of the paid period, subject to the store&#8217;s rules. <strong>Deleting your Eatper account, uninstalling Eatper, signing out, or withdrawing privacy consent does not cancel the subscription.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Refunds, purchase reversals, billing disputes, and statutory withdrawal requests are processed under the relevant app store&#8217;s procedures and applicable law. Nothing in these Terms limits any mandatory consumer right, including rights relating to withdrawal, conformity, remedies, or unfair terms. If the store cannot resolve an Eatper-specific issue, contact us.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may change subscription prices or paid features prospectively. The app store will provide any notice or obtain any consent required for a price change. A material reduction to already-paid access will not affect your mandatory rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8. Licence to use the Service<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use Eatper on devices you own or control and to access the Service for your own lawful, non-commercial use. App-store usage rules and legally required interoperability rights also apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This licence does not transfer ownership. Eatper and its software, design, branding, text, graphics, reports, and other materials are owned by Perplatform Oy or its licensors and are protected by intellectual-property laws. Rights not expressly granted are reserved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may not copy, distribute, sell, lease, publicly display, or create derivative works from the Service, or reverse engineer or circumvent technical restrictions, except to the extent that applicable law expressly permits those acts despite this restriction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9. Your content and the permissions you give us<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As between you and Eatper, you retain rights you may have in the diary entries, recipes, notes, photographs, and other content you submit (<strong>Your Content<\/strong>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subject to your privacy choices, the Privacy Policy, and applicable law, you give Eatper a non-exclusive, worldwide, royalty-free licence to host, copy, format, transmit, and otherwise process Your Content only as reasonably needed to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>provide, synchronize, secure, export, and support the Service;<\/li>\n\n\n\n<li>generate reports or insights when you have separately consented;<\/li>\n\n\n\n<li>investigate reports, enforce these Terms, and comply with law; and<\/li>\n\n\n\n<li>maintain the shared food catalogue in accordance with Section 6.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This permission ends when the relevant content is deleted, except for limited technical copies awaiting deletion, records lawfully retained under the Privacy Policy, and de-identified factual catalogue corrections that no longer identify you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You represent that you have the rights needed to submit Your Content and grant these permissions. You remain responsible for its accuracy and legality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10. Acceptable use<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must not:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>use the Service unlawfully, fraudulently, or to harm another person;<\/li>\n\n\n\n<li>submit malicious code, attempt unauthorized access, probe security, or disrupt the Service;<\/li>\n\n\n\n<li>bypass access, subscription, rate, or geographic controls;<\/li>\n\n\n\n<li>scrape, harvest, or systematically extract the Service or catalogue except through an expressly permitted export or as required by an applicable open-data licence;<\/li>\n\n\n\n<li>impersonate another person or create accounts using false or stolen credentials;<\/li>\n\n\n\n<li>submit knowingly false food information, abusive reports, unlawful content, or personal data about another person without a lawful basis;<\/li>\n\n\n\n<li>use automated systems to create excessive traffic or accounts without our written permission;<\/li>\n\n\n\n<li>use Eatper branding or content in a way that suggests endorsement; or<\/li>\n\n\n\n<li>help another person do any of these things.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Reasonable use of your own exports is permitted. Open Food Facts-derived data remains subject to its separate open-data licences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11. Open Food Facts and other third-party material<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Eatper includes food product data from Open Food Facts, provided by Open Food Facts contributors. The Open Food Facts database is available under the Open Database License 1.0, and individual database contents are available under the Database Contents License. Eatper does not import Open Food Facts images.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Attribution: <strong>Food product data \u00a9 Open Food Facts contributors \u00b7 ODbL 1.0.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Open-data licence conditions apply independently of these Terms. Where Eatper provides an export containing Open Food Facts-derived data, the export is separated and identified so the relevant licence obligations can be followed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Service may also link to or rely on third-party platforms, authentication services, app stores, notification systems, hosting services, and software libraries. Their terms may apply to your direct relationship with them. We are not responsible for third-party services outside our control, but this does not reduce any responsibility we have under mandatory law for the Eatper Service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12. App-store terms<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you obtained Eatper from Apple App Store, Apple&#8217;s Standard Licensed Application End User License Agreement governs the licence to the iOS application unless Apple displays another applicable licence. These Terms govern the Eatper account and Service in addition. Perplatform Oy, not Apple, provides Eatper support and is responsible for Eatper-related claims to the extent required by law. Apple is not responsible for Eatper maintenance or support.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you obtained Eatper from Google Play, the Google Play terms that apply to your download and purchases also apply. You must comply with the applicable app-store and device-platform terms when using Eatper.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13. Service changes, updates, and availability<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may improve, update, add, remove, suspend, or discontinue features for legitimate business, legal, security, or technical reasons. We may require an application update to keep using the Service. We will give reasonable notice of a material adverse change when practicable and where required by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Service may occasionally be unavailable because of maintenance, security response, network or app-store failures, or events beyond reasonable control. We do not promise uninterrupted or error-free operation. If a paid digital service fails to conform to mandatory consumer requirements, your statutory remedies remain available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for maintaining a compatible device, operating system, internet connection, and any backups or exports you reasonably need. Locally stored data may be lost if a device is lost, damaged, reset, or the application is uninstalled before synchronization or export.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">14. Suspension and termination<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may stop using Eatper at any time. You may request account deletion in the application&#8217;s Settings or contact support if you cannot access the setting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may restrict or suspend an account where reasonably necessary to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>protect users, the Service, or data;<\/li>\n\n\n\n<li>investigate suspected fraud, misuse, or a serious breach of these Terms;<\/li>\n\n\n\n<li>comply with law or a binding authority request; or<\/li>\n\n\n\n<li>address a material payment or entitlement problem.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We may terminate an account for a material or repeated breach after notice and a reasonable opportunity to remedy where appropriate. Immediate action may be taken for security threats, illegality, fraud, or conduct that creates a serious risk. Mandatory consumer rights and access to legally required data or remedies are preserved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sections that by their nature should survive termination\u2014including intellectual-property, open-data licensing, payment records, liability, disputes, and de-identified catalogue corrections\u2014continue to apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">15. Account deletion<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An account-deletion request immediately restricts account access and begins an asynchronous deletion process. The process deletes or de-identifies cloud account data as described in the Privacy Policy, including private diary, nutrition, body, weight, report, and user-owned custom-food data. We may retain only information that lawfully must or may be retained, such as limited financial records, fraud or security evidence, legal claims records, and a minimal non-identifying deletion audit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You should export any information you want to keep before deletion. An account export is temporary and expires as described in the Privacy Policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Account deletion does not cancel a subscription. Cancel separately through Apple App Store or Google Play to stop future charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">16. Warranties and responsibility<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We provide the Service with the care and skill required by applicable law. Except for rights and warranties that cannot lawfully be excluded, the Service is provided as available, and we do not promise that every food record, calculation, report, or result will be accurate, complete, suitable for your particular purpose, or continuously available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for the information you choose to enter and for how you use general wellness information. You are not responsible for losses caused by our breach of these Terms or failure to use legally required care.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To the maximum extent permitted by law, neither party is liable for indirect or unforeseeable loss. Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory privacy or consumer law, or any liability that cannot legally be excluded or limited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17. Indemnity for business misuse<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you use the Service on behalf of a business despite the personal-use restriction, or use it unlawfully for commercial redistribution, you will compensate Perplatform Oy for reasonable losses and third-party claims caused by that misuse, to the extent permitted by law. This Section does not apply to an ordinary consumer acting for purposes outside a trade or profession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">18. Changes to these Terms<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may update these Terms for changes to the Service, law, security, or business operations. We will present material changes in the Service and ask you to agree to the new version before continuing to use affected account features. For minor changes that do not materially reduce your rights, we may give notice by updating the date and making the new version available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Changes do not retroactively remove accrued rights or remedies. If you do not agree to a material update, you may stop using the Service and delete your account; paid-subscription cancellation must still be completed through the app store.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">19. Governing law and disputes<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms are governed by Finnish law, excluding its conflict-of-laws rules. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of habitual residence, and you may bring proceedings in any court available to you under mandatory consumer law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please first contact support@eatper.com so we can try to resolve the issue. Consumers in Finland may contact the Consumer Advisory Services and may refer an unresolved matter to the Finnish Consumer Disputes Board. The Board may require that you first contact Consumer Advisory Services. These voluntary routes do not prevent you from going to court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">20. General terms<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a provision is invalid or unenforceable, the remaining provisions continue to apply, and the affected provision applies only to the maximum lawful extent. Our delay in enforcing a provision is not a waiver. You may not transfer these Terms without our consent, but we may transfer them as part of a reorganization, merger, or sale of the Service, provided your mandatory rights and privacy protections continue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms, the Privacy Policy, the purchase terms shown by your app store, and any feature-specific terms presented before use form the agreement relating to the Service. If there is a conflict, mandatory law controls; then the more specific term controls for its subject matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">21.
